2. Scope
These terms apply to all sales made on bdmusic.fr to consumers. Customers accept them when placing an order. The applicable version is the one published on the website on the date of the order.
3. Products
Our products are illustrated albums (biography, comic book and one or more CDs, or a vinyl record for the Vinyl Story collection), as well as bundles. Their main characteristics are shown on each product page. Photographs are as accurate as possible but are not contractually binding. Offers are valid while stocks last. If a product becomes unavailable after you order, we will inform you and refund you without delay.
4. Prices
Prices are shown in euros, including VAT. Delivery charges are shown before you confirm your order. For deliveries outside the European Union, customs duties or import taxes may be payable by the customer when the parcel arrives. We may change our prices at any time, but you will be charged the price shown when you placed your order.
5. Orders
The customer selects products, checks the cart contents and total price, then confirms and pays for the order. The sale is concluded when payment is confirmed, and a summary email is sent to the customer. We may refuse or cancel an order in the event of a previous dispute, suspected fraud or an obvious pricing error.
6. Payment
Payment is due when you order, using the methods offered at checkout. Transactions are secured by our payment provider. We never have access to your card details.
7. Delivery
We deliver to the countries offered at checkout. Orders are prepared within 2 business days and then handed to La Poste (Colissimo) or another carrier. Delivery times shown are estimates. The risk of loss or damage passes to you when you, or a person you designate, receive the parcel. In the event of a significant delay, you may ask us to deliver within a reasonable additional period and, failing that, cancel the order and be refunded (Articles L216-1 et seq. of the French Consumer Code). If your parcel arrives damaged, let us know as soon as you receive it, with a photo.
8. Right of withdrawal and returns
The terms for withdrawal, returns and refunds are set out in our refund policy, which forms part of these terms. Please note that the right of withdrawal does not apply to sealed audio recordings that have been unsealed after delivery (Article L221-28 of the French Consumer Code).
9. Statutory guarantees
All our products are covered by the statutory guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code).
Under the guarantee of conformity, you have two years from delivery to report a defect. You may ask for the product to be repaired or replaced. If that is not possible, you may obtain a price reduction or cancel the sale. During these two years, you do not have to prove that the defect existed at the time of delivery.
Under the guarantee against hidden defects, you may take action within two years of discovering the defect, and choose between cancelling the sale and a price reduction.
10. Liability
We cannot be held liable in the event of force majeure or the act of a third party, or where non-performance is attributable to the customer, in particular an incorrect delivery address.
11. Intellectual property
The texts, illustrations, recordings and images on the website and in our products are protected by copyright. Any reproduction without permission is prohibited.
12. Personal data
Data collected when you order is used only to process your order and manage our customer relationship. How it is processed is described in our privacy policy.
13. Disputes
In the event of a dispute, please contact us first at bdmusic@bdmusic.fr or on +33 1 47 95 48 24. We undertake to seek an amicable solution. Failing that, the dispute may be brought before the competent courts.
14. Governing law
These terms are governed by French law. If you live in another country, you keep the protection granted to you by the mandatory provisions of the law of that country.
